1. Acceptance of Terms

By accessing or using the Automarket Bid website at automarket-bid.com (the "Platform"), you confirm that you are at least 18 years old, have the legal capacity to enter into binding agreements, and accept these Terms in full. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

2. Description of Service

Automarket Bid is an online marketplace that facilitates auctions for classic and sports automobiles. We connect verified sellers with prospective buyers through a transparent, competitive bidding process. Automarket Bid acts as an intermediary and is not a party to any transaction between buyers and sellers.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

3. User Accounts

To place bids or list vehicles, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Promptly update your information if it changes
• Notify us immediately of any unauthorized use of your account at support@automarket-bid.com
• Not share your account credentials with any third party

4. Bidding Rules

All bids placed on Automarket Bid are legally binding offers to purchase. By submitting a bid, you confirm that:

• You have the financial means to complete the purchase if your bid wins
• You have read and understood the vehicle listing, including condition reports and photos
• You accept that bids cannot be retracted once submitted, except in cases of clear technical error documented and reported within 15 minutes

Shill bidding, bid manipulation, or any form of fraudulent bidding activity will result in immediate account suspension and may be reported to relevant authorities.

5. Seller Obligations

Sellers must represent their vehicles honestly and accurately. By listing a vehicle, you warrant that:

• You are the legal owner or authorized agent of the vehicle
• All information provided in the listing is truthful and complete
• The vehicle is free of undisclosed liens or encumbrances
• You will complete the sale if the reserve price is met or no reserve was set

6. Fees and Payments

Automarket Bid charges a buyer's premium on successful auctions, calculated as a percentage of the final sale price. Seller listing fees, if applicable, are disclosed prior to listing. All fees are non-refundable unless otherwise stated. Failure to complete a purchase after winning a bid may result in fees and account suspension.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or systematically extract data from the Platform without written permission
• Post false, misleading, or defamatory content
• Harass, threaten, or intimidate other users
• Circumvent any security or authentication measures

8. Intellectual Property

All content on the Platform — including but not limited to logos, design, text, graphics, and software — is the property of Automarket Bid or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Automarket Bid does not warrant the accuracy of vehicle descriptions, the fitness of any vehicle for a particular purpose, or that the Platform will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Automarket Bid shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim shall not exceed the fees you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Automarket Bid and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Platform.

12. Privacy and Cookies

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described in those documents.

13. Modifications to Terms

We may update these Terms from time to time. When we do, we will update the version number and date at the top of this page and, where the changes are material, notify registered users by email at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware. In the event of discrepancies between translations of these Terms, the English version shall prevail.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
